Job Description

The Family Division General Magistrate position conducts hearings and enters recommended orders on matters referred for hearing. The position is responsible for setting referred cases for hearing, conducting hearings, making determinations on cases, and preparing recommended orders for the parties and referring judge’s consideration. The position works under the general supervision of the Court Administrator

Example Essential of Duties:

Reviews judge’s orders of referral, reviews motion paperwork, and conducts legal research in preparation for hearings on family law cases.

Schedules cases and conduct hearings in compliance with applicable rules and laws; gathers data in the form of documentary evidence and testimony.

Reviews recommended orders submitted by attorneys and considers or analyzes related research information presented at hearings to make case determinations.

Prepares recommended orders at the conclusion of hearings.

Makes rulings on pre-trial and post judgment motions including discovery, dismissal and motions for relief, clarification, and re-hearings.

Reads professional journals and updates of case law to stay current on rule changes and statutes governing civil and family court proceedings.

In emergency situations, the Chief Judge or Trial Court Administrator may assign the employee duties and responsibilities that are not associated with their primary function but are deemed to be mission essential.

Education and Training Guidelines

Education and Training:

Additional relevant experience may substitute for the recommended educational level on a year-for-year basis.

Juris Doctorate from an accredited law school is required for this position.

Experience:

Additional relevant experience may substitute for the recommended educational level on a year-for-year basis.

Five years of work experience in the practice of law, including one year in family law. Prior magistrate experience is preferred.

Membership in Good Standing in the Florida Bar.

Competencies

Requires considerable knowledge of the legal system, court processes and procedures, with an emphasis on family law related matters.

Must know civil procedure, family law rules, and be able to write detailed orders and make specific finding of fact.
